Mediation
Emotions may run very high in a divorce, a labour conflict or neighbours’ quarrel. If you are involved in a conflict like this you probably wish to end it as soon as possible. Mediation may be helpful in this case. An independent mediator can help you find a solution, which is acceptable to all parties involved. A legal battle may be avoided this way.
The way mediation works
A mediator is an independent third party, who can help you to solve your conflict. The mediator refrains from taking sides, thinking up solutions or taking decisions. He or she is a neutral party, who coaches you while you solve your conflict yourself.
The process of a mediation often starts when one of the parties involved in a conflict contacts us. We then invite all parties involved and discuss the issues in general. We also explain some important principles of mediation:
Confidentiality: all issues discussed will be confidential;
Voluntary participation: all parties involved in the conflict participate voluntarily. No one is forced to participate and you are free to withdraw from the mediation at any time.
If all parties involved agree on starting the mediation process, a mediation agreement will be drawn up, which includes the principles and agreements of the mediation. The agreement is signed by all parties involved. Everyone, including the mediator, is expected to follow up these agreements.
Several discussions will be held, in which everyone involved will get the opportunity to tell their story with the help of the mediator. Four to five discussions are usually necessary to reach a solution which is acceptable to everyone. A concluding document will be drawn up, including all rights and duties agreed upon, which will be signed by the parties involved.
